DEFENCE OF INDIVIDUALS AND LEGAL ENTITIES

The defence comprises legal representation and protection of the rights and interests of persons suspected and accused in criminal proceedings.

TAX CRIME

We provide legal services in all areas with a special focus on property offences and economic crime, in particular tax crime.

CRIMINAL COMPLIANCE PROGRAMME

Legal entities may be subject to criminal liability and may be sanctioned, with a fine of up to CZK 1.5 billion, a ban on exercising public contracts, the publication of their sentence, among other things.

A legal entity may be acquitted from criminal liability if it has made every effort that could be reasonably requested from it to prevent the commitment of the illegal act. This may be achieved through the criminal compliance programme, which is a comprehensive system of internal corporate measures and procedures to prevent, detect and tackle illegal acts.

We will tailor the criminal compliance programme to meet the client’s demands, in line with the requirements under the Corporate Criminal Liability Act and the best practices. Simultaneously, we can also provide related advisory, in particular assistance with the implementation, relevant training sessions, etc.

We also audit (review) existing programmes and make proposals for improvement.

ANALYSES AND CONSULTATIONS

We will analyse intended business or private transactions or acts from the criminal law perspective.

CRIMINAL INFORMATION AND REPRESENTATION OF INJURED PARTIES

We assist the injured and persons affected by criminal proceedings – we will draft and file a notice about the facts suggesting the possible commission of a crime, we represent the injured in criminal proceedings, and we assert the claim for compensation or non-material loss or the petition to secure a compensation claim from the accused person’s property.

LEGAL ASSISTANCE RELATED TO PROCEDURES IN CRIMINAL PROCEEDINGS

We render immediate and effective assistance with individual actions taken by investigative, prosecuting and adjudicating bodies, e.g. with rendering explanations, witness hearings, police requests for information, search of premises or search of other premises and land, seizures of property, etc.

INTERNAL INVESTIGATION

We carry out independent investigations of suspected illegal acts committed within a legal entity, prepare opinions regarding the matter and propose measures and procedures.

TRAINING

We share information and our know-how in criminal law.
